ListingPro Product Terms and Fair Housing Notice

These terms apply specifically to ListingPro. They supplement and, where they conflict, override the master Terms of Service for ListingPro use only.
1. What ListingPro is
ListingPro is a listing operations platform for real estate agents, brokers, and property managers. You enter property details. ListingPro produces MLS-ready descriptions, social media copy, deal analysis, comp analysis, client packets, and outreach materials in one pass.
2. Who is responsible for the output
You are.
This is not a soft disclaimer. It is the basic rule of fair housing law as it applies to advertising. The Fair Housing Act, the relevant HUD guidance, and your state and MLS rules all hold the licensee (you and your broker) responsible for every piece of marketing content you publish, regardless of who or what wrote it. We provide a tool. You decide what to publish.
This means:
- Every output requires your review before publication.
- Your broker's review and approval requirements still apply.
- Your MLS rules still apply.
- Your state real estate commission rules still apply.
- The National Association of Realtors Code of Ethics still applies, in particular Articles 2 (no exaggeration, misrepresentation, or concealment of pertinent facts) and 12 (honesty and truth in advertising).
3. Fair Housing Notice
The Fair Housing Act prohibits discrimination in housing advertising based on race, color, national origin, religion, sex (including sexual orientation and gender identity), familial status, and disability. Your state and local fair housing laws may protect additional classes (age, source of income, marital status, military status, ancestry, others).
HUD applies the Fair Housing Act to AI-generated advertising content. Disparate impact is enough; intent to discriminate is not required.
Language that signals a preference for or against a protected class can form the basis of a fair housing complaint. Examples include:
- "Perfect for families," "great for young professionals," "ideal for empty nesters" (familial status, age).
- "Walking distance to" specific religious institutions (religion).
- "Safe neighborhood," "good neighborhood" without factual basis (proxy for race or class).
- "Bachelor pad" (gender, marital status).
- References to neighborhood demographics or characterizations of who lives there.
The compliant approach is to describe the property, not the people. Describe what is there: square footage, condition, features, proximity to specific named amenities (transit, schools by name, specific stores). Do not describe who the property is for.
4. ListingPro's fair housing screen
Every output ListingPro produces runs through a fair housing language screen before delivery. The screen checks generated text against:
- HUD's Fair Housing Advertising Guidelines.
- The California Regional Multiple Listing Service (CRMLS) Fair Housing Keywords and Phrases guide (updated April 2025), which categorizes terms into "avoid," "use with caution," and "acceptable."
- NAR's fair housing guidance.
- Terms flagged by other major MLS systems.
When the screen identifies flagged language, the output is either rewritten before delivery or returned with a warning that the user must review before using.
We do not represent the fair housing screen as a complete compliance check. It catches known patterns. New patterns emerge. Context matters. You and your broker remain responsible for the final review.
5. Photo and image alteration
ListingPro's current scope is text generation. We do not currently alter listing photos with AI. If we add photo alteration features in the future, we will:
- Disclose the alteration in the listing output.
- Comply with California Assembly Bill 723 (effective January 2026), which requires disclosure of AI-altered listing photos and provides access to original unaltered photos in California.
- Add "Virtually Staged" or equivalent labels as required by the relevant MLS.
Until then, any photos you use with ListingPro outputs are your responsibility to source and label.
6. Accuracy of property data
ListingPro produces outputs from the property details you provide. We do not independently verify those details. If you provide incorrect square footage, condition information, year built, lot size, price, or other facts, the output will reflect those errors. Your duty to present a true picture of the property under Article 12 of the NAR Code of Ethics and your state license law is your responsibility, not ours.
7. Compliance with MLS rules
MLS rules vary by region. Some MLSs require specific disclosures, prohibit certain language, restrict claims that require verification, and have their own fair housing terminology guides. ListingPro outputs are not pre-cleared for any specific MLS. You are responsible for confirming that your output meets your MLS's requirements before submission.
8. Customer responsibilities
You agree that:
- You will review every ListingPro output before using it.
- You will obtain any required broker review and approvals.
- You will not publish any output without confirming fair housing compliance, MLS rules compliance, and accuracy.
- You will not use ListingPro to generate content that targets, excludes, or steers based on any protected class.
- You will not input fabricated property details.
9. Confidentiality of your inputs
Property details you enter into ListingPro are confidential to you. We do not disclose them to anyone except as needed to deliver the output. We do not use your inputs to train or improve any language model. See our Privacy Policy and Subprocessor List.
10. Free preview
We offer a free preview that produces a sample MLS description and deal snapshot. The preview is subject to the same use restrictions as paid outputs. Preview inputs are deleted within 30 days.
11. Pricing and access
Current pricing and what each tier includes is published at consumerdividends.com. Access is delivered after Stripe purchase. Unlimited tier permits up to three seats in one firm and includes white-label exports. Resale or sublicense outside your firm is prohibited.
