These terms apply specifically to Numidian. They supplement and, where they conflict, override the master Terms of Service for Numidian use only.

1. What Numidian is

Numidian is a structured risk inventory and scoring tool. You enter the facts of an employment situation across documented input fields. Numidian scores the organizational exposure across five dimensions (retaliation exposure, documentation strength, comparator risk, protected class factor, overall exposure index) using a fixed framework built on EEOC charge data, federal court timing patterns, and a fifteen-state law matrix. The output is a structured report.

Numidian is not legal advice. Using Numidian does not create an attorney-client relationship with Consumer Dividends Holding Corp or anyone associated with it. The structured risk report is a tool to inform a human professional's analysis, not a substitute for it.

Numidian is not an employment decision tool. Numidian does not make, recommend, or materially influence any decision to hire, fire, promote, demote, discipline, train, or otherwise act on any individual employee or applicant. Numidian assesses organizational and litigation exposure for the advisor or manager reading the report. Decisions about employees remain solely with the employer and their counsel.

Numidian is not an automated employment-related decision technology as that term is used in the Connecticut Artificial Intelligence Responsibility and Transparency Act (Public Act 26-15, Section 31-57aa et seq., applying to systems deployed on or after October 1, 2027) for the same reason: the output is not a substantial factor in any employment-related decision about an individual. It is a risk inventory for the firm's internal analysis.

Numidian is not a covered automated decision-making technology as that term is used in the Colorado Automated Decision-Making Technology Act (SB 26-189, effective January 1, 2027) for the same reason. The decision-maker is the employer. Numidian informs the analysis of the employer's advisors. Where a customer chooses to use a Numidian output as an input to a consequential decision about an individual, that customer is the deployer and bears the compliance obligations of the law that applies to them.

4. Confidentiality of your inputs

Case facts you enter into Numidian are confidential to you. We do not disclose them to anyone except as needed to deliver the report (see our Privacy Policy and Subprocessor List). We do not use your inputs to train or improve any language model. Pro and Agency tier users have access to historical reports through the dashboard. Single-report and 5-pack tier users have access for the duration of their access window.

If you are bound by confidentiality obligations to your own clients, you are responsible for confirming that entering information into a software tool is consistent with those obligations. We provide a Data Processing Addendum to Agency tier customers on request.

5. The scoring framework

Numidian's scoring framework is documented at a high level in our public materials and in detail in customer onboarding for Agency tier. The core elements:

The framework is fixed. The same inputs produce the same scores. We update the framework as case law and EEOC data evolve. Updates are dated and customers are notified of material changes.

6. Free trial

We offer a free trial with the code FREE-TRIAL. The trial produces one full report with all input fields available. Trial reports are subject to the same use restrictions as paid reports. Trial inputs are deleted within 30 days.

7. Pricing and access

Current pricing and what each tier includes is published at consumerdividends.com. Access is delivered by email after Stripe purchase. We do not run accounts in the traditional sense for one-time tiers; the access code is your credential. For Pro and Agency tiers, your access code grants you the dashboard and history features described on the website.

8. No defense against discrimination claims

This is worth stating directly. Under the Connecticut Fair Employment Practices Act as amended by the CART Act, the use of an automated employment-related decision technology is not a defense to a discrimination claim. Other states are adopting similar positions. Even though Numidian is not, under the legal definitions referenced in Section 2 above, an AEDT or covered ADMT, our customers should understand: using a software tool to assess your exposure does not insulate you from liability for a discriminatory decision. Numidian helps you see the risk. It does not absolve you of the duty to act lawfully.
